نزع وزرع الأعضاء البشرية على ضوء قانون الصّحة رقم 18- 11. أية فعالية؟

Résumé: الملخص: تعتبر عمليات نقل وزرع الأعضاء البشرية من أهم الإنجازات العلمية في العصر الحديث، وهذا لكونها قد تكون الوسيلة الوحيدة لإنقاذ العديد من المرضى المحكوم عليهم بالموت المحقق أو معاناتهم من الأمراض المستعصية، غير أنّ هذه العمليات، تعتبر من أكثر المواضيع جدلا واختلافا في الأوساط العلمية والقانونية والفقهية من منطلق تعلقها بمعادلة التوفيق والتوازن بين المخاطر والمصلحة التي تعود على المريض والمجتمع وسلامة المتبرع، الأمر الذي اقتضى وضع ضوابط قانونية تتجه إلى المحافظة على السّلامة الجسدية دون الحد من روح التّحديث والابتكار، وهذا ما يستشف من القانون رقم 18-11 المتعلق بالصّحة، وبعض النّصوص القانونية والتّنظيمية ذات الصّلة بالموضوع. َAbstract: Organ transplantation is considered one of the most significant scientific achievements in the modern era. It can be the only means to save many patients who are facing certain death or suffering from incurable diseases. However, these procedures are highly controversial and subject to disagreements in scientific, legal, and religious circles due to the delicate balance between risks, benefits to the patient and society, and the safety of the donor. This necessitated the establishment of legal regulations aimed at preserving physical integrity while promoting advancements and innovations. This is reflected in Law No. 18-11 related to health and other relevant legal and regulatory texts on the subject.
