الآليات الموضوعية لتسليم المجرمين في نطاق اتفاقيات التعاون القضائي الدولي

Résumé: الملخص: إن التقدم العلمي ساهم كثيرا في تطور العالم وسهل الكثير من الأمور لاسيما وسائل المواصلات بين الدول وسقوط الحواجز والحدود بينها بما صاحبه سهولة تنقل الجناة، هذا ما استوجب التعاون القضائي الدولي للحد من الجريمة ومكافحتها وذلك من خلال الية تسليم المجرمين، التي تتمثل في تخلي الدولة على شخص موجود على اقليمها لدولة أخرى بناء على طلبها لتتولى محاكمته عن جرائم منسوبة إليه أو تنفيذا لحكم صادر من محاكمها، وهوما حاولنا الوقوف عليه من خلال تحليل الضوابط الموضوعية لتسليم المجرمين وكذا النصوص القانونية المتعلقة باتفاقيات التعاون القضائي الدولي. Abstract: The scientific progress has contributed greatly to the development of the world and facilitated many things, especially the means of transportation between countries, and the fall of barriers, including the ease of the escape of offenders. That what has necessitated the international judicial cooperation to reduce crime and fighting it through the mechanism of extradition, which is to renounce a State a person on its territory to another State at its request to be tried for crimes attributed to him or for the execution of a judgment issued by her courts. Which we have tried to determine by analyzing the objective criteria of extradition and the legislation relating to international judicial cooperation agreements.
