دور القاضي الاداري في إثبات عيب الانحراف في إستعمال السلطة -دراسة مقارنة-

Résumé: تنصب هذه الدراسة حول دور القاضي الاداري في اثبات عيب الانحراف في إستعمال السلطة ، حيث يتقصى القاضي الإداري عند بحثه في مدى مشروعية ركن الغاية أية قرائن تشير إلى انحراف الإدارة العمومية بسلطتها عن المصلحة العامة، أو الغرض المخصص في قراراتها، ويتميز هذا العيب بصعوبة في الإثبات لخصوصيته، حيث يتصف بجانب شخصي كامن في نفسية مصدر القرار يصعب تحريها، فما هي الاليات القانونية التي ابتدعها القاضي الاداري في إثبات عيب انحراف الادارة العمومية في استعمال سلطتها ؟ وما مدى فعالية دوره في الرقابة على الانحراف بالسلطة ؟ دأب القاضي الإداري على توسيع وسائل إثبات هذا العيب، فلم يكتف بفحص القرار نفسه أو أوراق الملف، وإنما دأب على البحث وتحري الانحراف بالسلطة من الظروف الخارجية للنزاع المطروح أمامه .
