The Necessity Of Transforming From A Public Institution Of An Industrial And Commercial Nature Towards A Public Economic Institution

Résumé: In this article, I discussed the public institution of an industrial and commercial nature as one of the most effective methods of managing a public facility. However, taking care of the public economic facility has become a burden on the state budget, and in the same context, the form of the state has changed from an intervening state to a controlling state that does not directly interfere in economic activity in application of the rules of the market economy. Add to that the administrative aspect, which limits its purely economic nature. All of these previous data add to the current orientation of Algeria in the economic field and therefore the institution of an industrial and commercial nature and considering the latter as a real economic operator with the aim of achieving profit, but this reality clashes with the legal nature of the public institution of an industrial and commercial nature, which has become an inevitable necessity for it to take the form of the economic field and to search for effectiveness in performing public service in the field of economic that affected the legal nature of the national company. For Electricity and Gas. تطرقت في هذا المقال إلى المؤسسة العمومية ذات الطابع الصناعي والتجاري كواحد من أنجع أساليب تسيير المرفق العام، لكن أصبح التكفل بالمرفق العام الاقتصادي يثقل كاهل ميزانية الدولة و أيضا في نفس السياق تغير في شكل الدولة من دولة متدخلة إلى دولة ضابطة لا تتدخل مباشرة في النشاط الاقتصادي تطبيقا لقواعد اقتصاد السوق، ضف إلى ذلك الشق الإداري الموجود في طبيعتها القانونية الذي يفرض عليها أداء خدمة المرفق العمومي الاقتصادي و هذا الذي يحد من طبيعتها الاقتصادية البحتة، كل هذه المعطيات السابقة ضف ان التوجه الحالي للجزائر في المجال الاقتصادي نحو التخلي عن الدعم المباشر لخدمات المرافق العامة الاقتصادية و بالتالي المؤسسة العمومية ذات الطابع الصناعي و التجاري و اعتبار هذه الأخيرة متعامل اقتصادي حقيقي يهدف لتحقيق الربح، لكن هذا الواقع يصطدم بالطبيعة القانونية للمؤسسة العمومية ذات الطابع الصناعي و التجاري الذي أصبح من الضرورة الحتمية أن تأخذ شكل المؤسسة العمومية الاقتصادية الاصلح في المجال الاقتصادي و للبحث عن الفعالية في أداء الخدمة العمومية في مجال المرافق العامة الاقتصادية مثال ذلك التغيير الذي مس الطبيعة القانونية للشركة الوطنية للكهرباء و الغاز .
