Résumé: تبنى عادة العلاقة بين المرافق العامة ذات الطابع الصناعي والتجاري وفكرة المصلحة العامة على الدور الذي تلعبه في تلبية احتياجات المجتمع الاقتصادية والاجتماعية، بتوفر الخدمات بجودة عالية وأسعار، ومعلوم أنها تخضع لنظام قانوني مزدوج يجمع بين القانون العام في تعاملاتها مع الدولة، والقانون الخاص في عقودها التجارية، لضمان التوازن بين تحقيق الربح وتقديم خدمة المصلحة العامة، لكن من جانب أخر فإن الأعباء الثقيلة التي أصبحت تتحملها الدولة تستلزم اعادة النظر في بعض الأمور، فإذا كان تفويض المرفق العام هو احدى الوسائل التي يعتمد عليها لتخفيف الأعباء على الدولة، فإن اخراج بعض المرافق من دائرة المرافق العامة هو احدى الحلول الممكنة، وعلى ذلك يغوص هذا المقال في اثارة الجدل حول مدى وجود مفهوم حقيقي للمصلحة العامة في المرافق الصناعية والتجارية. The relationship between public utilities of an industrial and commercial nature and the concept of public interest is usually based on the role they play in meeting the economic and social needs of society, by providing high-quality services at reasonable prices. They are subject to a dual legal system that combines public law in their dealings with the state and private law in their commercial contracts, to ensure a balance between making a profit and serving the public interest. However, the heavy burdens that the state has come to bear require reconsideration of certain matters. While the delegation of public utilities is one of the means relied upon to alleviate the state's burdens, removing some utilities from the realm of public utilities is one of the possible solutions. This article delves into the controversy over the existence of a real concept of public interest in industrial and commercial utilities.
