عملة البيتكوين (bitcoin) وحكم التعامل بها في الفقه الإسلامي والقانون الجزائري

Résumé: الملخص: تعرف عملة البيتكوين (Bitcoin) الافتراضية انتشارا كبيرا عبر دول العالم ومن ضمنها العالم الإسلامي، ورغم ذلك لا يزال غالبية الناس يجهلون حقيقة هذا النوع من العملات باعتبارها نازلة جديدة على مستوى النظام النقدي العالمي، فعلى غرار سرعة انتشارها وارتفاع قيمتها في وقت قياسي استحدثت منصات افتراضية ووسائط مبادلات جديدة قادرة على تخطي الطرق التقليدية المعتمدة في تنظيم تبادل السلع والخدمات، وفي ظل ما تشكله العملات الافتراضية من تساؤلات جاءت هذه الدراسة لبيان حقيقة عملة البيتكوين (Bitcoin) بوصفها أشهر العملات الافتراضية تداولا، وبيان مدى مشروعية التعامل بها من الناحية الشرعية والقانونية. Abstract The Bitcoin virtual currency has witnessed a great widespread across the globe including the Islamic world. Owing to the fact that it is an up-to-date issue, the majority of people are still ignorant of the reality of this type of currency at the level of the global monetary system. Subsequent to the quickness of its spread and the rising of its value in a record time, virtual platforms and new modes of exchange, able to skip traditional methods adopted in regulating the exchange of goods and services, have been developed. The current investigation is an attempt to determine the reality of bitcoin currency being the most popular virtual currency traded with reference to the legitimacy dealing with it either from the legal or the religious side.
