الاختصاص القضائي في منازعات الاستثمار العقاري Jurisdiction In Real Estate Investment Disputes

Résumé: تتناول هذه الدراسة بيان دور الاختصاص القضائي في تكريس دولة القانون عند النظر في منازعات الاستثمار العقاري، فعند حصول الضرر الناتج عن أعمال الاستثمار العقاري أو بمناسبتها يكون على المتضرر اللجوء للقضاء سواء القضاء العادي أو الإداري بغية الحصول على تأكيد حقه أو الحصول على التعويض المناسب، من هنا تأتي هذه المداخلة لتسلط الضوء على اختصاص الجهات القضائية الإدارية والعادية عند معرض تناولها لمنازعات أعمال الاستثمار الفلاحي. This education deals with the role of the competent judicial authorities in the establishment of the rule of law when considering the disputes of construction and reconstruction. When the damage resulting from the construction or reconstruction works is incurred, the victim must resort to meet both the ordinary and the administrative courts in order to obtain his right or appropriate compensation , Hence comes this intervention to highlight the jurisdiction of the administrative and ordinary judicial bodies when dealing with disputes of construction and reconstruction
