الإختصاص الإقليمي للمحكمة الجنائية الدولية على حالة فلسطين

Résumé: تُشكل حالة فلسطين المعروضة على المحكمة الجنائية الدولية اختبارا حقيقيا لهذه الأخيرة في مكافحة الإفلات من العقاب، و ذلك بالنظر للمسائل القانونية و الواقعية و حتى السياسية المحيطة بهذه الحالة.تطرقت هذه الدراسة للإجراءات التي اتخذتها المحكمة على حالة فلسطين و التي وصلت إلى مرحلة الشروع في التحقيق ، إثر القرار التاريخي للدائرة التمهيدية القاضي بتحديد نطاق الاختصاص الإقليمي للمحكمة على هذه الحالة ، و الذي وضع حدا للجدال القانوني الدولي بخصوص هذه المسألة ، بعد أكثر من عشر سنوات من أول محاولة للفلسطنيين طرق باب العدالة الجنائية الدولية. The situation of Palestine before the ICCourt constitutes a true test for the latter in combating impunity, given the legal, factual and even political issues surrounding this situation. This study deals with the measures taken by the court in the situation of Palestine, which has reached the stage of initiating an investigation, following the historic decision of the Pre-Trial Chamber to determine the scope of the Territorial jurisdiction of the court over this situation, which put an end to the international legal debate on this issue, after more than ten Years of the Palestinians' first attempt to knock on the door of international criminal justice.
