امتداد الاختصاص الإقليمي للمحكمة الجنائية الدولية إلى الأراضي الفلسطينية Extension Of The International Criminal Court To The Palestinian

Résumé: ملخص: يتحدد نطاق اختصاص المحكمة الجنائية الدولية الإقليمي بنطاق جغرافي محدد لا يحق لها أن تمارس سلطتها خارج حدوده، ومن أهم شروط هذا النطاق أن محل الاختصاص يجب أن يكون دولة ذات سيادة ، وترتب على ذلك حرمان فلسطين من إحالة حالتها إلى مدعي عام المحكمة الدولية بالرغم من أن الجرائم المرتكبة على أراضيها بلغت من الجسامة حدا أدخلها في اختصاص المحكمة. وكان لقرار الجمعية العامة للأمم المتحدة قبول عضوية فلسطين كدولة مراقب أثر فعال في تغيير مسار الأحداث حيث سارعت السلطة الفلسطينية بالانضمام إلى اتفاقية روما لتصبح العضو 122 في النظام الأساسي للمحكمة الجنائية الدولية ، وهو الأمر الذي سيخولها حق الادعاء على الكيان الصهيوني ومتابعته أمام المحكمة عن الجرائم المرتكبة على أراضيها في حق الشعب الفلسطيني. الكلمات المفتاحية: المحكمة الجنائية الدولية;الاختصاص الإقليمي; الجمعية العامة للأمم المتحدة;حالة فلسطين. Abstract: The international criminal court regional function is determined according to geographical determination,it does not have the right to play its authority outside its jurisdiction among the conditions that the country should be sovereign; in fact it is the thing that deprived Palestine from assigning its case to the prosecutor of the international court despite of the crimes committed on its lands which reached enormity that enters within the function of the court. However the resolution of the general assembly of the UN which accepted the membership of Palestine as a country observer has influenced the course of events, the Palestinian authority rushed to join the Rome convention to be 122 member in the principal system of international criminal court the thing that will give it the right to claim against Zionist entity and follow it up on the crimes committed in its lands against the Palestinian people.
