Résumé: ملخص: يعتبر الاجتهاد القضائي المسلك الذي يتبعه القضاة في أحكامهم سواء منها ما يتعلق بنصوص القانون أو استنباط الحكم الواجب تطبيقه عند غياب النص القانوني، إن تفشي جائحة كورونا كوفيد 19 التي أثرت على مختلف المجالات التي لم يتوقع حدوثها الأشخاص ولدت حالة من الفراغ القانوني لكون هذا الأخير لم يكن مهيأ لاستيعابها فتدخل القضاء المقارن لمعالجة الآثار القانونية المترتبة عنها. الكلمات المفتاحية: اجتهاد قضائي، مقارن، جائحة، فراغ قانوني. تصنيف JEL :. K19, K10, I190, K10 Abstract: Judicial jurisprudence is the behavior that judges follow in their judgments, whether they relate to the provisions of the law or develop provisions that must be applied in the absence of a legal text. After the outbreak of the Covid 19 pandemic, which affected various areas that people did not expect, a state of legal vacuum was born, as the latter was not ready to absorb it, so that compared justice intervened to deal with the legal consequences of this legal vacuum.
