جائحة كوفيد-19... مصالحة الحقوق والحريات الأساسية مع النظام العام الصحي Covid-19 Pandemic... Reconciling Fundamental Rights And Freedoms With The Healthy Public Order

Résumé: الملخص: تشكل الجائحة الناجمة عن ظهور وسرعة انتشار فيروس كوفيد-19 وضعية وبائية استثنائية في التاريخ المعاصر للبشرية، لذلك وجدت مختلف دول العالم نفسها مجبرة على اتخاذ تدابير ضبطية مقيدة لممارسة بعض الحقوق والحريات الأساسية للأفراد لمواجهة وكبح انتشار هذا الفيروس، مبررة بهدف المحافظة على النظام العام الصحي، ومؤسسة على نظرية الظروف الاستثنائية، التي تبيح كلاسيكيا للسلطات الإدارية الخروج عن قواعد المشروعية العادية لمواجهة أي ظرف استثنائي يهدد النظام العام في المجتمع. تتناول الدراسة أحد أهم الآثار القانونية المترتبة على هذه الجائحة الاستثنائية ممثلة في كيفية مصالحة أو موازنة ممارسة الحقوق والحريات الأساسية للأفراد مع المحافظة على النظام العام الصحي في ظل الظرف الاستثنائي المرتبط بهذه الجائحة، بوصفه شرطا ضروريا لضمان الاستقرار الاجتماعي والممارسة الفعلية لهذه الحقوق والحريات. Abstract: The pandemic caused by the emergence and rapid spread of the Covid-19 virus is an exceptional epidemiological situation in contemporary history, therefore various countries of the world found themselves obliged to take measures restricting the exercise of certain fundamental rights and freedoms of individuals to confront and curb the spread of this virus, justified by the maintaining of public health order, and based on the theory of exceptional circumstances, which classically allows administrative authorities to deviate from the rules of regular legality in order to confront any exceptional circumstance that threatens public order in society. The study examines one of the most important legal effects of this exceptional pandemic, which is how to achieve conciliation between the exercise of fundamental rights and freedoms and the maintaining of public health order under the exceptional circumstance associated with this pandemic, as a necessary condition for ensuring social stability and the effective exercise of these rights and freedoms.
