Résumé: يعتبر النظام القانوني في الجزائر من الأنظمة التي تأخذ بمبدأ الفصل بين السلطات، فلا يمكن لأي سلطة تجاوز صلاحيات سلطة أخرى، فقد تم حصر الاختصاص التشريعي للبرلمان في الدستور وأطلق صلاحيات رئيس الجمهورية في غير تلك المحجوزة للبرلمان، لكن تمتع رئيس الجمهورية بصلاحية اصدار المراسيم الرئاسية التي تتمتع بالاستقلالية التي يصمنها الدستور قد تؤثر على عمل البرلمان وقد يتدخل في اختصاصاته مما قد يشكل تجاوزا للسلطة وهناك عدة امثلة نذكر اهمها قانون الصفقات العمومية من الجانب المالي. The legal system in Algeria is one of the systems that adopt the principle of separation of powers an authority that overrides the powers of another authority, The legislative competence of parliament has been limited to the constitution and the powers of the president of Republic have been granted to others other than those reserved for parliament. However, the president of Republics enjoyment of the power to issue presidential decrees that enjoy the independence guaranteed by the constitution may affect the work of parliament and may interfere in its competencies, which constitutes a threat. Bypassing the authority, and there are several examples to mention, the most important of which is the law of public procurement from the financial side.
