المرجعية القانونية للنشاطات الاقتصادية العمومية

Résumé: تخضع النشاطات العمومية الاقتصادية في ظل الانفتاح على المنافسة إلى مرجعية تضع لها الضوابط التي تسير عليها وكذلك الإطار المؤسساتي الذي تسلكه للتجسيد نشاطها . تتمثل الضوابط في تلك المبادئ العامة التي يقوم عليها القانون العام الاقتصادي والتي تضفي على التدخل العمومي المشروعية أما بالنسبة للمؤسسات التي تجسد هذا التدخل فهي تتخذ صورتين وهما صورة الشخص المعنوي العام وهي المؤسسات التجارية والصناعية التي تهدف الى تحقيق المصلحة العامة والصورة الثانية فهي المؤسسة العمومية الإقتصادية التي تجسد الوظيفة المقاولاتية للدولة . Public economic activities, in light of openness to competition, are subject to a reference that establishes the controls that govern it, as well as the institutional framework that it adopts to embody its activity. The controls are represented in those general principles on which the general economic law is based and which give legitimacy to public intervention. As for the institutions that embody this intervention, they take two forms, which are the image of the public moral person, which is the commercial and industrial institutions that aim to achieve the public interest, and the second image is the economic public institution that It embodies the entrepreneurial function of the state.
