تقييم الأثر البيئي وعلاقته بحماية البيئة من الآثار السلبية للنشاط الصناعي في الجزائر / Environment Impact Assessment And Its Relationship To Protecting The Environment From The Negative Effects Of Industrial Activity In Algria

Résumé: ملخص: لحماية البيئة من التدهور الذي يتسبّب فيه النشاط الصناعي، إعتمد المشرّع الجزائري على نظام تقييم الأثر البيئي للمؤسسات الصناعية، من خلال إلزام صاحب المشروع بإعداد دراسات بيئية استشرافية تهدف الدراسة لتوضيح الآليات القانونية المتعلقة بتقييم الأثر البيئي وعلاقتها بتحسين الأداء البيئي للمؤسسات الصناعية. وقد خلصت الدراسة إلى أن التقييم القبلي للأثر البيئي للمشاريع الصناعية، يمكّن متّخذي القرار من الضبط البيئي للنشاط الصناعي لضمان حماية البيئة ومواردها الطبيعية من المخاطر الصناعية Abstract: To protect the environment from deterioration it causes by industrial activity, the Algerian legislator relied on the system of tribal assessment of the environmental impact of industrial enterprises, by obliging the project owner to prepare prospective environmental studies. The study aims to clarify the legal mechanisms related to environmental impact assessment and its relationship to improving the environmental performance of industrial entreprises. The study concluded that the prior pre-evaluation of the environmental impact of industrial projects enables decision-makers to control the environment of the industrial activity to ensure the projection of the environment and its natural resources from industrial risks.
