خصوصية مقتضيات الحصول على براءة الاختراع الحيوية

Résumé: إن المعرفة والتقدم العلمي في تطور مستمر، مما جعل العالم في ثورة علمية متواصلة، أخطرها ثورة الهندسة الوراثية مادتها الجينات التي أصبحت تستخدم في عدة ميادين. ويراد بالتكنولوجيا الحيوية التطبيقات التكنولوجية التي تستخدم النظم البيولوجية أو الكائنات الحية أو مشتقاتها لصنع أو تغيير المنتجات أو العمليات من أجل استخدامات معينة. ألزمت اتفاقية تربس الدول الأعضاء فى منظمة التجارة العالمية بأن تتيح فى تشريعاتها الوطنية إمكانية حصول جميع الاختراعات على براءة اختراع ، طالما توافرت شروط الحصول على البراءة، سواء أكانت منتجات أم عمليات صناعية، فى كافة ميادين التكنولوجية. إذ ما يتوصل إليه المخترع يكون بحاجة إلى حماية قانونية من خلال الحصول على براءة اختراع. والجدير بالذكر أنه في مجال التكنولوجيا الحيوية يجب على المخترع أن يثبت التدخل التقني للحصول على المادة محل طلب براءة الاختراع ناهيك عن شروط خاصة أخرى . تهدف هذه الدراسة إلى التعريج على خصوصية مقتضيات الحصول على براءة الاختراع الحيوية نظرا لطبيعتها. Knowledge and scientific progress are constantly evolving, which has made the world in a continuous scientific revolution, the most dangerous of which is the revolution of genetic engineering, the material of which is genes, which are now used in several fields. Biotechnology means technological applications that use biological systems, living organisms, or their derivatives to make or alter products or processes for specific uses. The TRIPS Agreement obligates the member states of the World Trade Organization to allow in their national legislation the possibility of all inventions obtaining a patent, as long as the conditions for obtaining a patent are met, whether they are products or industrial processes, in all fields of technology. The findings of the inventor need legal protection by obtaining a patent. It is worth noting that in the field of biotechnology, the inventor must prove the technical intervention to obtain the material in question of the patent application, not to mention other special conditions. This study aims to explore the specificity of the vital patent requirements due to their nature.
