موقف المشرع الجزائري من إجارة الأرحام

Résumé: مس التطور التكنولوجي جوانب عديدة لمختلف مجالات الحياة الاقتصادية، الطبية، الاجتماعية حتى أن العلاقة الزوجية كان لها نصيب منه، حيث تمحور ذلك حول الإفراز التكنولوجي الطبي وعملية الإنجاب عن طريق التلقيح الاصطناعي أوعملية استئجار الرحم لتتحول عملية الإنجاب من علاقة ثنائية شرعية بين الزوجين إلى علاقة ثلاثية الأطراف تتكون من الزوج أوالزوجة أوهما أوأي شخصين آخرين والأم البديلة بإبرام عقد بموجبه يتم تسليم الطفل بعد الوضع وحصول المرأة التي استأجر رحمها أوبويضتها على مقابل لقيامها بعملية الحمل لحساب الغير، إذ مؤخرا أصبح عقد تأجير الأرحام وظيفة تمتهنها النساء للحصول على المال دون النظر إلى مدى مشروعية هذا العقد في القانون الجزائري والآثار المترتبة عنه مع إهمال لقضية النسب. The technological development had touched many aspects of the various fields of life particularly the economic , the medical and the social one ; and as all these fields the marital relationship had taken her share ; where this last appears in the new advances of reproduction and the medical excretion talking about the abortion or the artificial insemination which from a legitimate bilateral relationship between the spouses into a trilateral relationship consisting of a husband or a wife or of them together or of two other persons and the alternative mother ; For the conclusion of a contract under which the child is delivered after the birth and access of the woman who hired her womb or her mother in exchange for the process of pregnancy for others. As recently becomes a contract for the lease of the womb a profession for women to get money without considering the legitimacy of this contract in the Algerian law or his legal effects ignoring also the descent history.
