إسباغ صفة الإذعان على العقود المختلة معرفيا

Résumé: ملخص: أوجدت التشريعات أساليب تعالج فيها اختلال التوازن العقدي الذي يؤثر بالمراكز العقدية للأطراف، ولذلك وفي سبيل إعادة التوازن العقدي واجه المشرع الشروط التعسفية في عقود الإذعان بمفهومها التقليدي كاستثناء على القاعدة العامة ثم أسبغ صفة الإذعان على العقود الناتجة من التفاوت المعرفي لتحقيق حماية واسعة للطرف الضعيف وهذا دون الإخلال بالأمن التعاقدي والقانوني. Abstract: The Legislation has created ways and methods to deals contractual imbalance, which affects the contractual centers of the parties. Therefore, in order to restore the contractual balance, the legislator faced arbitrary terms in adhesion contracts with traditional concept as an exception to the general rule and then bestowed the status of compliance with contracts resulting from knowledge inequality to achieve broad protection for the weak party.
