Résumé: Abstract : The tremendous development witnessed by both the field of information technology and the field of communications and the amazing merger that occurred between them later, which was the main axis on which information technology was based, as all the different sectors depended in the performance of their work on the use of electronic systems, but despite the enormous advantages of this technology However, there are negative repercussions as a result of the bad and illegal use that harmed the individual and society alike. This is what is called cybercrime, which raised many problems within the scope of the Code of Criminal Procedure, whose texts were developed to govern the procedures related to traditional crimes, and there are no great difficulties in proving and investigating them. And this is what made many countries conclude agreements and enact internal laws in order to provide protection and fight this type of crime, and one of these countries is Algeria. The Algerian Code of Criminal Procedure provides only for the general rules that apply to traditional crimes as well as to electronic crimes through some special procedures represented in the seizure of data as well as the monitoring of electronic communications. Some procedures are a common denominator between traditional crimes and electronic crimes such as inspection and control of digital evidence, while the new procedures Regarding cybercrime, it was stipulated in the amendment of the Code of Criminal Procedures in 2006 and in Law 09-04, which includes special rules for the prevention and control of crimes related to information and communication technologies, and despite the existence of legal texts, the fight against electronic crime is subject to procedural obstacles in the field of follow-up and the first obstacle is The lack of technical qualification for the investigation authorities, which leads to the destruction of evidence and the impunity of the perpetrators of these crimes.
