حدود النيابة في التصرفات الإلكترونية

Résumé: بفعل تقدم التكنولوجيا تطور الذكاء الاصطناعي مكن برنامج الوكيل الالكتروني من البحث عن السلع والخدمات وفقا للمواصفات والمعايير التي حددها التعاقع وابرام عقد عند العثور عليها دون تدخل او علم من المستخدم. وقد استخدمة هذه الرامج كسيلة للتعبير عن الإرادة تتضمن عرضا للتعاقد أو ايجابا او قبول وتتميز الرسائل الصادرة من هذا البرامج من انها تعمل من خلال أنظمة معلوماتية . ان غياب الحلول القانونية المناسبة وغياب الاسس القانونية والمعايير الدولية للتعامل مع الوكلاء الالكترونيين ستأدي الى الى وجود صعوبات لحل اي نزاع قائم ينشأ نتيجة استخدام هذه البرامج. وفي كل الاحوال لا تتحق مسؤولية الموكل الا بتحقق مسؤولية الوكيل الالكتروني وفي انتظار تحيين القوانين الخاصة بالوكيل الإلكتروني تبقى القواعد العامة للقانون هي المرجع. الكلمات المفتاحية: التجارة الالكترونية، النيابة في التعاقد، النيابة الالكترونية. Abstract : Due to the advancement of technology, the development of artificial intelligence has enabled the electronic agent program to search for goods and services according to the specifications and standards set by the contracting party and conclude a contract when found without interference or knowledge from the user. These programs have been used as a means of expressing will, including an offer to contract, an offer, or acceptance. The messages issued by these programs are distinguished by the fact that they work through information systems. The absence of appropriate legal solutions and the absence of legal foundations and international standards for dealing with electronic agents will lead to difficulties in resolving any existing dispute that arises as a result of the use of these programs. In all cases, the principal’s responsibility is not fulfilled unless the responsibility of the electronic agent is achieved.
