السجل التجاري الالكتروني ضمانة لتأطير المعاملات التجارية الالكترونية

Résumé: ملخص: بالنظر لمسعى المشرع الجزائري لرقمنة خدمات الإدارة، فقد حاول تسهيل عملية التسجيل في السجل التجاري من خلال إمكانية القيد بالطريقة الالكترونية، وهو ما تضمنه القانون رقم 13-06 في نص المادة 05 مكرر المعدل للقانون 04-08 المتعلق بشروط ممارسة الأنشطة التجارية، وتبعا لذلك صدر المرسوم التنفيذي رقم 15-111 الذي يحدد كيفيات القيد والتعديل والشطب في السجل التجاري، التي نصت على إمكانية التسجيل في السجل التجاري وارسال الوثائق المتعلقة بها بالطريقة الالكترونية، كما قد دعم اجراء القيد الالكتروني المرسوم التنفيذي رقم 18-112 الذي يعد بادرة مهمة من قبل المشرع من أجل تسهيل عملية القيد وتدعيم وظائف السجل التجاري، والذي عدل سنة 2018 و2021، هذا كله لوضع وإرساء المشرع الجزائري لبيئة مناسبة للمعاملات التجارية الالكترونية. الكلمات المفتاحية: التاجر؛ السجل التجاري الالكتروني؛ المرسوم التنفيذي رقم18-112. Abstract: In view of the Algerian legislator’s endeavor to digitize management services, he tried to facilitate the registration process in the commercial registry through the possibility of registering in an electronic way, which was included in Law No. 13-06 in the text of Article 05 bis amended to Law 04-08 related to the conditions for conducting commercial activities, and accordingly it was issued Executive Decree No. 15-111 that defines the modalities of registration, amendment and write-off in the Commercial Register, which provided for the possibility of registering in the Commercial Register and sending related documents electronically. In order to facilitate the registration process and strengthen the functions of the commercial registry, which was amended in 2018 and 2021, all this is to establish and establish the Algerian legislature for an appropriate environment for electronic commercial transactions. key words: Merchant; Electronic commercial register Executive; Decree No. 18-112.
