السجل التجاري الالكتروني في القانون الجزائري

Résumé: أصدر المشرع مجموعة من القوانين و المراسيم من أجل تهيئة بيئة رقمية من أجل ممارسة التجارة الالكترونية، عن طريق عصرنة قطاع التجارة، بالأخص السجل التجاري نظرا لدوره الإحصائي و الاقتصادي و الإشهاري؛ ما دفعنا إلى البحث في مدى تنظيم المشرع لقواعد السجل التجاري الالكتروني لاسيما أنه عبارة عن تشفيرة في النظام المعلوماتي للمركز الوطني للسجل التجاري؟؛ لاسيما بعد صدورالقانون رقم 18-05 المتعلق بالتجارة الالكترونية الذي ساهم في تفعيل المواقف التشريعة الخاصة بالسجل التجارية، على سبيلها القانون رقم 18-04 المتعلق بشروط ممارسة الأنشطة التجارية المعدّل و المتمم؛ الذي ترتب عنه إصدار المرسوم التنفيذي رقم 18-112 الذي يحدّد نموذج مستخرج السجل التجاري الصادر بواسطة إجراء الكتروني المعدّل والمتمم و الذي يفرض مطابقة كل التجار غير الحائزين على الرمز الالكتروني مطابقة سجلاتهم، ما جعل الالتزام بالسجل التجاري الالكتروني حتمية تجارية. The legislator has issued a series of laws and decrees to create a digital environment for the conduct of electronic commerce, through the modernization of the trade sector, particularly the trade register due to its statistical, economic and advertising role, this led us to search the texts regulating it particularly as they were encrypted into the information system of the National Center for Commercial Registry? The issuance of the law n°18-05 on electronic commerce has given effect to the legislative positions on commercial registration, for example, Law n°18-04 related to the conditions for practicing commercial activities as modified and completed, which resulted in the issuance of Executive Decree No. 18-112 that specifies the form of the commercial registry extractor issued by electronic procedure as modified and completed; that made commitment to the electronic commercial registry a commercial imperative.
