Résumé: يتميز التحكيم أمام المركز الدولي لتسوية منازعات الاستثمار بخصوصية جعلته يختلف عن التحكيم أمام الهيئات التحكيمية الأخرى، وتظهر هذه الخصوصية من خلال توسيع نطاق اختصاص المركز بقبول التحكيم في النزاع دون وجود اتفاق التحكيم وذلك بالاستناد إلى تشريعات الاستثمار الداخلية أو اتفاقيات الاستثمار الدولية ، كما تظهر خصوصية التحكيم أمام المركز أيضا في التزام الدول بالاعتراف بأحكام التحكيم الصادر عن المركز وتنفيذها وفقا لشروط خاصة حددتها اتفاقية واشنطن تختلف عن شروط تنفيذ أحكام التحكيم الأجنبية الأخرى، بالإضافة إلى تكريس الحماية الدبلوماسية والمطالبة القضائية أمام محكمة العدل الدولية كضمانة في حالة امتناع الدولة المضيفة عن تنفيذ الحكم. The arbitration before (ICSID) is characterized by a specificity that makes it different from arbitration before other international bodies. To clarify this specificity, emphasis was placed on some of the key points of expanding the Centre's jurisdiction to arbitrate the dispute in the absence of any agreement based on the domestic investment legislation of the host State or an (IIA ) with obligation of the States members of the Washington Convention to recognize and enforce the Centre's arbitral award without judicial supervision, in addition to establishing diplomatic protection and judicial claim before the International Court of Justice as a guarantee in the event of the host State's failure in execution of the judgment.
