الهجرة القسرية واللجوء: اشكالات مفاهيمية وانعكاس للامساواة في حرية التنقل

Résumé: تعتبر قضية الهجرة القسرية ضمن ما تحتويه من مفاهيم كاللجوء من أكثر القضايا حساسية لارتباطهما بعوامل متعددة أمنية واجتماعية واقتصادية وبيئية وحتى إنسانية، باعتبار أن دوافع الهجرة واللجوء كظاهرتين ازدادت حدتهما منذ نهاية الحرب الباردة نظرا لتزايد وتعدد العوامل المسببة لهما، إلا أنهما إلى حد ما أصبحا مفهومين غامضين خاصة في ظل مضمون المفهوم التقليدي لكل من الهجرة القسرية واللجوء والذي لم يعد يعبر عن حقيقتهما، لذا فان هذه الدراسة تحاول توضيح مختلف أنواع الهجرة واللجوء والأسباب الدافع لهما بدراسة نقدية تحيط بمختلف أنواع الهجرة واللجوء الموجودان واقعيا والغائبان قانونيا بتحديد مضمون الهجرة واللجوء والمفاهيم التي تتقاطع معهما، خاصة في ظل ما يشهده العالم اليوم ضمن جائحة كوفيد-19 وتبعاتها كتقييد حرية التنقل استجابة للضرورات الصحية ضمن جواز سفر صحي وهو ما زاد من تعقيد مفهوم الهجرة بشكل عام باعتبارها تعكس اللامساواة في الحق في الحركة والتنقل بغض النظر عن طبيعتها. The issue of migration and refugee is one of the most sensitive issues linked to multiple security, social, economic, environmental and even humanitarian factors. The motives for migration and refugee have increased since the end of the cold war and become vague concepts, especially given the content of the traditional concept of both forced migration and asylum, which is no longer true. Thus, this study attempts to clarify the different types of migration and refugee and the reasons behind them by critically examining the different types of migration that exist realistically and are legally absent by determining the content of migration and asylum and the concepts that intersect with them. especially in the light of what the world is witnessing today in the Covid-19 pandemic and its consequences, such as the restriction of freedom of movement in response to health needs within a health passport, have further complicated the concept of migration and freedom of movement in general.
