Résumé: إن أحد آثار فيروس (COVID-19) على المستوى الدولي، هو إثارته للعديد من الإشكالات القانونية في العقود الصناعية والتجارية والخدمية التشغيلية والالتزامات المالية والمسائل الضريبية ذات الارتباط، حيث دفعت العديد من الشركات العالمية المتخصصة في مجالات مختلفة مثل الطاقة والغاز والنقل الجوي والشحن وصناعات السيارات وقطع الغيار والمواد البترولية والتكنلوجيا، بوجود حالة القوة القاهرة force majeure)) أوالظروف الاستثنائية الطارئة (exceptional and unpredictable events) أوحالة الإخفاق ومعوقات تنفيذ العقد (frustration) من أجل وقف تنفيذ التزاماتها التعاقدية مؤقتا وإعادة ترتيب التزاماتها وفقا للظروف المستجدة دون فرض غرامات التأخير أو التعويض عن التأخير في تنفيذ هذه العقود. مما لا شك فيه ان الاوبئة تفرض نفسها كواقعة مادية تكون لها آثار سلبية واضحة يمكن رصد ملامحها على العلاقات القانونية بوجه عام وعلى العلاقات التعاقدية على وجه الخصوص حيث تتصدع هذه الروابط نتيجة ركود يصيب بعض قطاعات الاستثمار مما يجعل من المستحيل او على الاقل من الصعب تنفيذ الالتزامات أو يؤخر تنفيذها . One of the effects of COVID-19 virus at the international level is its raising of many legal problems in industrial, commercial, service operational contracts, financial obligations and related tax issues, where many international companies specializing in various fields such as energy, gas, air transport, shipping and Automotive, spare parts, petroleum and technology industries, in the presence of force majeure, exceptional and exceptional circumstances (exceptional and unpredictable events) or failures and impediments to the implementation of the contract (frustration) in order to temporarily suspend the implementation of its contractual obligations and rearrange its obligations in accordance with the new circumstances Without imposing delay fines or compensation for delays in the execution of these contracts. There is no doubt that epidemics impose themselves as a material reality with clear negative effects that can be monitored on legal relations in general and on contractual relations in particular, where these linkages are broken as a result of a stagnation affecting some investment sectors, making it impossible or at least difficult to implement commitments or delay their implementation.
