Résumé: إن الحكم القاضي بعقوبة سالبة للحرية كثيرا ما تكون له آثار سلبية على المحكوم عليه و على أسرته و المجتمع، فبدلا من إصلاحهم يتحولون الى ذوي السوابق و الخبرة الإجرامية نتيجة اتصالهم واحتكاكهم بذوي السوابق معتادي الإجرام. إضافة إلى إرهاق الخزينة العمومية بمصاريف المحكوم عليه. وانطلاقا مما سبق اتجهت السياسة الجنائية المعاصرة إلى إعادة النظر في السياسة العقابية المتبعة والبحث عن بدائل أكثر فعالية. والتساؤل يدور حول علاقة وقف تنفيذ العقوبة الجنائية مع سياسة الحد من العقاب، وكيف عالج المشرع الجزائري نظام وقف تنفيذ العقوبة.
