آثار تنفيذ عقد الوكالة المحفزة في ظل المرسوم 18-199المتعلق بتفويضات المرفق العام

Résumé: بعد تحقق شروط الإبرام ودخول العقد التفويضي "الوكالة المحفزة" حيز التنفيذ، فإن هذا العقد يأتي مرتبا لجملة من الآثار في حق كل من السلطة المفوضة والمفوض له تمثل هدف هذه الورقة البحثية، حيث: يصبح للسلطة المفوضة جملة من الوسائل القانونية التي تمكنها من متابعة التنفيذ والتي تتمثل في الرقابة والتوجيه وكذا سلطة التعديل المنفرد لإلتزاماتها العقدية. وفي المقابل ونظرا لخطورة هذه الوسائل والسلطات الممنوحة للسلطة المفوضة قدر المنظم الجزائري وضع مجموعة قيود وضوابط يضمن من خلالها عدم تعسف السلطة المفوضة في ممارسة سلطاتها، وذلك بمنح المفوض له في المقابل جملة من الحقوق لكن أقر له أيضا جملة من الإلتزامات.
