تأثير مبدأ انتخاب مجالس المنظمات المهنية على تكييفها القانوني

Résumé: تدار المنظمات المهنية بواسطة مجالس منتخبة من قبل أبناء المهنة الذين يقومون باختيار مجلس المنظمة عن طريق الانتخاب، وطالما أنه لا يمكن للجميع البت في المسائل المهنية؛ نظراً للكم العددي الكبير ولعدم إمكانية البت في القضايا لتعذر اجتماع الكل في جلسـة معينـة. فمن المنطقي أن يترك أمر اختيار القائمين على إدارتها لأصحاب المهنة بطريقة الانتخاب، كنوع من الاستقلالية الإدارية للمنظمات المهنية التي أكد عليها المشرع في القوانين المنظمة للمهن، ومنحها بعض امتيازات السلطة العامة الأمر الذي أثر على تكييفها القانوني لتكون بذلك ووفقاً لرأي الغالب فقهاً وقضاءً أحد أشخاص القانون العام. Professional organizations are managed by councils elected by the people of the profession who choose the organization's board by election, as long as they cannot all decide on their professional issues due to their numerical quantity, and because it is not possible to quickly decide on issues because it is not possible for everyone to meet in a particular session, it is logical to leave the matter of choosing those in charge of their management to the owners of the profession by election, as a kind of administrative independence for professional organizations that the legislator emphasized in the laws regulating professions, and granting them some of the privileges of public authority This affected its legal adaptation to be in accordance with the opinion of the majority of jurisprudence and the judiciary of a public law person.
