المعالجة القانونية لجريمة استهلاك المخدرات (وفقا للقانون 04-18)

Résumé: الملخص: آفة المخدرات من أخطر الآفات الماسة بالمجتمعات،ولم تتوان الجزائر في محاربتها لذلك كانت من الدول السّباقة في الانضمام إلى مختلف الاتفاقيات الدولية المكافحة لهذه الآفة بكل أشكالها(الجرائم) منذ 1963،وعلى الصعيد التشريعي كان قد صدر قانون الصحة العمومية سنة 1976 الذي تناول بعض النصوص المتعلقة بالمخدرات تحت عنوان "المواد السامة" وكذلك الأمر في قانون الصحة وترقيتها لسنة 1985،لكن بقيت جرائم المخدرات في تفاقم ،لذلك رأى المشرع إصدار قانون خاص بجرائم المخدرات سنة 2004 جاعلا هدفه الأول الوقاية من المخدرات والمؤثرات العقلية من جهة وقمع الاستعمال والاتجار غير المشروعين بها من جهة أخرى متبنيا بذلك فكرة أن العقاب ليس الحل الأنسب لبعض الجرائم ،ولعل ذلك ينطبق على جريمة استهلاك المخدرات التي وضعها المشرع من خلال القانون رقم 04-18 بين نوعي الجزاء العقاب وتدبير الأمن،ووضع مستهلكي المخدرات أمام خيارين إما العلاج وإما العقاب. Abstract: The drug scourge is one of the most dangerous scourges affecting societies, and Algeria did not hesitate to fight it, so it was one of the first countries to join the various international conventions combating this scourge in all its forms (crimes) since 1963, and from a legislative point of view, the Public Health Law was issued in 1976, which dealt some texts related to drugs titled “Toxic Substances” as well as the order in the Health and Promotion Law of 1985, nevertheless, drug Related-crimes continued to escalate which led the legislator to issue a drug-crimes related law in 2004 that aims to prevent drugs and their effect on the mind and to suppress the illegal use and trafficking in them. The legislator also see that punishment is not the most appropriate solution for some crimes, and that my applies on the drug consumption crime that the legislator has established through the law 18-04 That’s why the legislator decided to make it in front of two options ,either punishment or treatment
