الأبعاد القانونية لتعطيل ممارسة الصلوات الجماعية في ظل جائحة كوفيد-19

Résumé: الغرض من هذه الورقة هو تأثير التدابير المتخذة لمواجهة جائحة كوفيد-19، التي شملت تعطيل وتقييد حرية التجمع والاتصال الجماعي. تحولت الجائحة إلى أزمة صحية عامة وحادة، مما أرغم الحكومة على تقييد بعض الحقوق والحريات الأساسية، من بينها تعطيل إقامة الصلوات الجماعية بسبب إغلاق المساجد. كان مبرر الإغلاق هو حفظ الصحة والسلامة العامة للمجتمع، لأن التجمعات الكبيرة في الأماكن العامة تشكل خطرا وسببا لانتشار الفيروس. كما تناقش هذه الورقة مدى امتثال التدابير الاستثنائية المتخذة لأحكام المادة 4 من العهد الدولي لحقوق الإنسان المدنية والسياسية، التي تجيز للدول تقييد الحقوق والحريات الأساسية. ومدى حياد وشمولية تلك التدابير، فيما خص حظر التجمعات العامة. مع ضمان حماية الحقوق والحريات الأساسية المكفولة دستوريا وقانونيا، في ظل سيادة القانون. : The purpose of this paper is to study the impact of general quarantine measures, which included disrupting and restricting freedom of assembly and collective contact to limit the Covid-19 pandemic. There is an acute public health crisis that has forced the government to restrict basic rights and freedoms, including suspending the holding of collective prayers. The justification was to preserve public health and safety, as gathering in public places constitutes a danger and a reason for the spread of the virus. The paper also discusses the exceptional nature of these measures and their compatibility with the conditions and standards enshrined in the International Covenant on Civil and Political Rights. Adherence to them will guarantee and protect fundamental rights and freedoms under the rule of law
