الإطار القانوني للمؤسسات الناشئة في الجزائر-المعوقات والأفاقا

Résumé: إن بناء أي مشروع اقتصادي مهما كانت طبيعته ونجاعته لا يحظى بالنجاح في غياب الأرضية القانونية والتنظيمية المرافقة له، الأمر ذاته بالنسبة للمؤسسات الناشئة التي تعتمدها الدولة الجزائرية كنمط اقتصادي بديل للنهوض بالاقتصاد الوطني. في هذا المنظور، تهدف هذه الورقة البحثية تحديد الإطار القانوني للمؤسسات الناشئة وطبيعتها القانونية وشكلها القانوني الذي يتناسب مع وظيفتها وأهدافها. وخلصت الدراسة إلى أن المؤسسات الناشئة تنفرد بخصوصيات متميزة تستدعي مراجعة القانون التجاري والقوانين المنظمة لمناخ الأعمال والتجارة. The construction of any economic project, whatever its nature and efficiency, does not succeed in the absence of the legal and regulatory ground accompanying it, as does the emerging institutions adopted by the Algerian state as an alternative economic pattern for the advancement of the national economy. In this perspective, this paper aims to define the legal framework of emerging institutions, their legal nature and legal form that is commensurate with their function and objectives. The study concluded that start-ups have distinct peculiarities that require a review of commercial law and laws regulating the business and trade climate
