تعارض فكرة السيادة الوطنية والتعاون القضائي الدولي لمكافحة جريمة الاتجار بالبشر

Résumé: ملخص: عرفت جريمة الاتجار بالبشر امتدادا كبيرا، فأصبحت تشكل تهديدا مباشرا للأمن والاستقرار الدوليين، وعائقا أمام السلطات التشريعية والسياسية، بل وتعدت أحيانا سلطة الدولة نفسها، والمؤكد اليوم أنه بلغت بعد الحروب والنزاعات المسلحة والإرهاب، حدا من الخطورة إلى درجة التأثير على السلم والأمن العالميين. ويعتمد الاختصاص الجنائي للدولة على المدلول التقليدي للسيادة الوطنية وحدودها، والتي تتوقف بحسب الأصل على إقليم الدولة ومواطنيها ومصالحها الذاتية، فيمتد إلى ما يقع على الإقليم من جرائم أو ما يقع من مواطنيها أو عليهم، مما جعل هذا الأمر يتعارض مع فكرة التضامن الدولي؛ لأن الدول تربطها ببعضها مصالح مشتركة لا تنحصر فيما يدور داخل إقليمها أو فيما يتعلق بمواطنيها أو مصلحتها الذاتية؛ لذا اجتاز القانون الحدود الوطنية، وامتدت طموحات الدول، بما فيها الجزائر، لمكافحة جريمة الاتجار بالبشر، واتسعت أوجه مواجهة هذه الجريمة التي تبدأ من مراحل قبل تحقيقات الشرطة وقبل وقوع الجريمة، وتمتد طوال مراحل البحث والمحاكمة وما يتخللها من إجراءات، ولا تنتهي بصدور الحكم، بل تستمر إلى ما بعد تنفيذ العقوبة. وفي هذا الصدد تطرح الإشكالية الآتية: هل اعترضت فكرة السيادة الوطنية مسألة التعاون الدولي القضائي باجتياز الحدود الوطنية لمجابهة التهديدات المتصاعدة لجريمة الاتجار بالبشر؟ Abstract: The crime of trafficking in human beings has become a major threat, which has become a direct threat to international security and stability, a hindrance to the legislative and political authorities and, at times, the authority of the State itself. Today it is certainly after wars, armed conflicts and terrorism. Is so dangerous as to affect world peace and security. The criminal jurisdiction of the State depends on the traditional connotation of national sovereignty and its limits, which depend on the territory of the State, its citizens and its own interests, depending on the origin of the territory, its crimes or its citizens or others, which is contrary to the idea of international solidarity because States are bound together Common interests are not limited to what is going on within its territory or with regard to its citizens or self-interest. Thus, the law passed national borders, and the aspirations of states including Algeria to combat the crime of trafficking in human beings expanded. The faces of this crime, which began from the stages before police investigations and before the crime, expanded throughout the research and trial stages and procedures, after the execution of the sentence. In this connection, the following problem arises: Has the notion of national sovereignty interfered with the question of international judicial cooperation by crossing national borders to counter the growing threats of human trafficking?
