الإجراءات المستحدثة للضبطية القضائية في جرائم الفساد وفقا للقانون 19/10 New Procedures For Judicial Police To Detect Corruption Crimes In Accordance With Law 10/19

Résumé: الملخص: استحدث المشرع إجراءات للضبطية القضائية بهدف الكشف عن جرائم الفساد بموجب القانون 19/10 المتضمن تعديل قانون الإجراءات الجزائية، حيث قام بتوسيع صلاحيات ضباط الشرطة القضائية إلى العديد من الجهات الأمنية تسهيلا لعمليات البحث والتحري، لا سيما بخصوص التحري عن جريمة من جرائم الفساد، كما ألغى القانون 19/10 المواد التي تعرقل سير إجراءات البحث والتحري والكشف عن جرائم الفساد، منها تأهيل ضباط الشرطة القضائية المنصوص عليها وفقا للمواد 15 مكرر 01 و15 مكرر 02 من القانون 17/07، أو رفع شرط الشكوى المشترط في الدعوى العمومية ضد مسيري المؤسسات العمومية الاقتصادية المنصوص عليها بالمادة 06 مكرر من القانون 15/02 المعدل والمتمم لقانون الإجراءات الجزائية، حيث إن شرط الشكوى في الجرائم التي يتم ارتكبت من مسيري المؤسسات العمومية الاقتصادية كان يشكل عائقا أما النيابة العامة لتحريك الدعوى العمومية. Abstract: The legislator introduced procedures for judicial police with the aim of detecting corruption crimes under Law 10/19, which includes amending the Criminal Procedure Code, as he expanded the powers of judicial police officers to many security agencies in order to facilitate search and investigation operations, especially with regard to investigating a crime of corruption, and the law was also repealed 10/19 Articles that impede the conduct of research, investigation and detection of corruption crimes, including the qualification of judicial police officers stipulated in accordance with Articles 15 bis 01 and 15 bis 02 of Law 17/07, or the lifting of the complaint condition stipulated in the public lawsuit against managers of public economic institutions provided for It is subject to Article 06 bis of Law 02/15 amending and supplementing the Code of Criminal Procedure, as the requirement to complain about crimes committed by the managers of public economic institutions was an obstacle for the Public Prosecution to initiate a public lawsuit.
