نظام الترخيص المسبق لضمان الحق في الخصوصية بالتشريع الجزائري (دراسة مقارنة)
Résumé: تسعى الدراسة الحالية لإبراز أهم الدعائم التي يقوم عليها نظام الترخيص المسبق الذي جاء على ذكره المشرع الجزائري بالقانون رقم 18-07 والمتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي، إذ أصبح ضروريا توفير أقصى حماية ممكنة لحقوق الشخص المعني بالمعالجة وذلك من خلال تفعيل نظام الترخيص المسبق وإنشاء سلطة مستقلة لحماية المعطيات الشخصية، كضمانة قانونية محكمة القواعد الموضوعية والإجرائية تحول دون إمكانية الاعتداء عليها من قبل المسؤول عن المعالجة أو المعالج من الباطن، أو حتى من الغير، في نطاق مجتمع المعلومات الإلكترونية. The current study seeks to highlight the most important pillars on which the prior licensing system is based; which was mentioned by the Algerian legislator in Law No.18-07 related to the Protection of natural persons in the field of data processing of a personal nature, as it became necessary to provide the maximum possible protection for the rights of the rights of the person concerned by activating.
