الإستغلال القانوني لبراءة الاختراع

Résumé: تعتبر براءة الاختراع الوسيلة القانونية لإضفاء الحماية القانونية على الاختراع موضوع البراءة، إذ تعتبر سند الملكية لصاحبها، و ما يترتب على ذلك من قصر الأستئثار بالاختراع و الاستفادة منه بالطرق القانونية لصاحبه وحده ، و يعتبر الترخيص بإستغلال الاختراع موضوع البراءة أحد الحقوق التي أقرها القانون لصاحب البراءة ، إلا أن هذا الحق الذي تمنحه البراءة لصاحبها ليس حقا مطلقا، بل أنه مقيد زمانيا و مكانيا ، و سنرى من خلال هذا البحث كيف أجبر المشرع صاحب الاختراع مو ضوع البراءة على الإستغلال الفعلي للإختراع بنفسه أو عن طريق الترخيص للغير بإستغلال البراءة أو قد يكون محلا للترخيص الإجباري.The patent is a legal way to give legal protection to dubrevet invention. as the deed of Property of its owner. and the monopolizing invention therefore Palace and profit by legal means to its owner alone. and the license to exploit the invention is the subject of the patent one of the rights approved by the law of the patent owner. but this is the right granted by the patentee is not an absolute right. but it is limited in time and space. and we will see through this research how forced legislator His invention is the subject of a patent on the actual exploitation of the invention by himself or by the authorization of a non-exploitive patent He can make the subject to a compulsory license.
