أثر جائحة كورونا في الموازنة بين المصالح والمفاسد-كلية الدّين والنفس أنموذجا

Résumé: الملخص: تسعى هذه الورقة إلى بيان أثر العلاقة بين موازنة المصالح والمفاسد المتعلقة بكليتي الدين والنفس في الشرع وجائحة كورونا المستجد ، وذلك من خلال الكشف عن معايير الموازنة بين هذه المصالح والمفاسد المتعلقة بكليتي الدين والنفس، ودورها وأثرها في الحكم والقول على العديد من المسائل والنوازل التي أفرزتها جائحة كورونا المستجد وما انجر عنها من تداعيات، حيث قد تم التوصل من خلال هذا البحث إلى أنه لابد من تفعيل معايير الموازنة بين كليتي الدين والنفس للوصول للراجح في مختلف المسائل الشرعية المتعلقة بكوفيد 19 والتي ظهر فيها التعارض بين المصالح والمفاسد المتعلقة بكليتي الدين والنفس، والذي أدى إلى الوقوع في إشكالات فيها، ولقد تم توضيح تلك العلاقة المهمة وأثرها من خلال عرض بعض النماذج الفقهية التي أبرزت ذلك، وهذا من شأنه إظهار خاصية صلاحية الشريعة الإسلامية لكل زمان ومكان.
