التحكيم الالكتروني في عقود التجارة الالكترونية.

Résumé: إن الطبيعة الخاصة لعقود التجارة الإلكترونية والمنازعات التي يمكن أن تنشأ بخصوصها ،والتي لم تعد تستوعبها الطرق العادية للتقاضي ، هذا ما استدعى اللجوء إلى التحكيم الإلكتروني كآلية حديثة لتسوية هذا النوع من النزاعات ، نظرا لما يتميز به من خصائص تتلاءم وطبيعة هذه التجارة. وعليه سنوضح من خلال هذا المقال: الإطار النظري والإجرائي للتحكيم الإلكتروني. The special nature of e-commerce contracts and the disputes ,that can arise in relation to them and which are no longer absorbed by the regular methods of litigation, This necessitated the resort to e-arbitration as a modern mechanism for settling this type of disputes due to its characteristics that are compatible with the nature of this trade. So we will clarify through this article, theoretical and procedural framework for electronic arbitration.
