المسؤولية المدنية للروبوت بين الواقع واستشراف المستقبل

Résumé: إن وجود الروبوت في حياتنا اليومية ومنافسته للإنسان ليس في حركاته ومهاراته فقط، بل حتى في تفكيره، نتج عنه اشكال قانوني يتعلق بتحديد المركز القانوني للروبوت، سواء من حيث الاعتراف له بالشخصية القانونية من عدمه، وتكييف المسؤولية القانونية المترتبة على الروبوت، حيث أن البحث في مجال المسؤولية المدنية للروبوت يرتبط بنظرة المشرع التكييف القانوني المناسب له، أي ما إذا كان يأخذ وصف الشيء، وأن مالكه مجرد حارس عليه، أم أنه كيان قانوني يتمتع بالشخصية القانونية. وتوصلنا من خلال هذا البحث إلى إثبات قصور قواعد المسؤولية المدنية التقليدية المنظمة وفقا لأحكام القانون المدني على الروبوت، ولذلك لا بد من البحث في مدى إمكانية محاكاة المشرع الأوروبي في مسألة الاقرار بفكرة النائب الانساني عن الروبوت كمسؤول عن أخطاء الروبوت، ولما لا امكانية الاعتراف بالشخصية القانونية للروبوت، وكذلك ضرورة صياغة نصوص قانونية ملاءمة للبيئة الوطنية وخادمة لها في هذا المجال. The existence of the robot in our daily lives and its competition with humains in the kinetic and intellectual spheres resulted in a legal problem determining the legal status of the robot. Whether in terms of recognition of his legal personality or not, and adapting of the legal liability of the robots Research into the civil liability of robots is linked to the legislators view of the legal adaptation appropriate for him. If a robot is a thing , then its owner is just a knowledgeable guard or it is a legal entity that has legal personality Through this research ,we will work on clarifying the deficiencies of the traditional rules of civil liability organzid according to the provisions of the civil law on the robot.We are looking into the possibility of simulating European law in the issue of recongnizing the idea of the humain representative of the robot and why the legal personality of the robot cannot be recognized
