Provisions Of Internet Subscription Contract - A Comparative Study -

Résumé: صاحب ثورة تكنولوجيا المعلومات زيادة ملحوظة في حجم الاعتداء على حقوق المشتركين ومخالفة القانون، وبهدف الوصول إلى الاستخدام الأمثل لشبكة الإنترنت وضبط قواعد السلوك في محيط البيئة الرقمية وذلك لكل من مستخدمي الشبكة والمهنيين، فكان التدخُّل التشريعي في عدد من الدول،لايجاد الإطار القانوني الناظم لعقد الإشتراك في خدمات الانترنيت خاصةً من قِبل المشرِّع الأُوروبي ومن بعده الفرنسي، على عكس المشرع الجزائري الذي لم يتبن نصوصا خاصة تحكم هذا النوع من العقود المستحدثة رغم التعديلات الأخيرة خاصة ما تعلق منها بالقانون 18-04 المتعلق بالبريد والإتصالات الإلكترونية، الأمر الذي يستدعي بناء صياغة تشريعية إلكترونية تُرسي نظاماً قانونياً متوازناً وملائماً لطبيعة العمل على الإنترنت، ولتُحدِّد بالنتيجة التزامات كل من مستخدمي الشبكة والقائمين على إدارتها من مقدمي الخدمات بمختلف صورهم مع تحديد الطبيعة القانونية لمثل هذا العقد الذي لا يزال محل جدل فقهي . الكلمات المفتاحية: مقدمي الخدمات، الأنترنيت ،الخدمات ،عقد اشتراك،تكنولوجيا الإعلام والإتصال.
