عقوبة العمل للنفع العام كبديل للعقوبة السالبة للحرية قصيرة المدة في التشريع الجزائري
Résumé: يُعالج هذا المقال إحدى بدائل العقوبات السالبة للحرية, ألا وهي عقوبة العمل للنفع العام, والتي تبناها المشرع الجزائري في سنة 2009 واعتبرها عقوبة بديلة للعقوبة السالبة للحرية قصيرة المدة, تماشيا مع السياسة العقابية المعاصرة التي ترتكز على احترام حقوق الإنسان والعمل على إعادة الإدماج الاجتماعي للمحكوم عليهم واستثمار العقوبة بتوجيهها للنفع العام بدلا من الحبس وما يترتب عنه من أثار سلبية. كما يهدف إلى تسليط الضوء على كل ما يتعلق بهذه العقوبة, مع التركيز على شروطها وإجراءاتها وإشكالاتها القانونية والعملية. Abstract: This article treated oneof alternative of freedom punishment substitutes, which is a punishment of the work for public benefit,it was adopted by the Algerian legislator in 2009 and considered. It's alterative short termed punishment, in line with the modern punishment policy.This based on respecting human rights and working on reintegrate the convicted socialy to be sentenced and invested the punishment and directed it to the work for public benefit in exchange for the imprisonment and consequent from them in the negative effects. It also tried to shed-light everything related for this punishment, with a focus on it’s conditions, procedures, law and practical problems.
