Résumé: أثبتت التجربة العملية عدم جدوى العقوبة السالبة للحرية في تحقيق الردع والتأهيل والإصلاح، على اعتبار أن هذه الأخيرة تتميز بالقسوة وسلب الحرية من الفرد؛ إذ تشير الإحصائيات إلى أن جرائم العود في تزايد مستمر، وأن السجون أصبحت لا تحتمل استيعاب العدد الهائل والمضطرد من المجرمين، فقد اهتمت السياسة العقابية المعاصرة بالبحث عن بدائل عقابية تحل محلّها، وتعتبر عقوبة العمل للنفع العام في الوقت الحالي من أهم هذه البدائل، حيث تعاقبت التشريعات المقارنة على الأخذ بها كوسيلة لإصلاح وتأهيل المحكوم عليهم وإعادة وإدماجهم في المجتمع، ولقد حذا المشرع الجزائري حذو التشريعات الأخرى التي تبنّت هذه العقوبة وأخذ بها في سنة 2009 كعقوبة بديلة لعقوبة الحبس النافذ المنطوق بها والتي لا تتجاوز السنة، وقد حاولنا من خلال هذه الدراسة تسليط الضوء على كل ما يتعلق بهذه العقوبة وما يميزها بإبراز الدور الإيجابي لعقوبة العمل للنفع العام كبديل للعقوبة السالبة للحرية قصيرة المدة.

we have tried through this study to shed light on all matters relating to the death penalty and what distinguishes it by highlighting the positive role of the death work public utility as an alternative for negative punishment short of freedom period.
