مبررات حماية المستهلك في التجارة الالكترونية

Résumé: إن فكرة إحاطة المستهلك بالحماية القانونية ليست فكرة حديثة أو قاصرة علـى عقـود التجـارة الإلكترونية. فالمسـتهلك يحتاج إلـى الحماية إذا كــان الطــرف المقابــل لــه فــي العقــد محترفــاً. لأن المستهلك في هذه العقود يعتبر طرف ضعيف مقارنة بالمهني .وعليه يهدف هذا البحث الى دراسة المبررات التي تدعو الى إحاطة المستهلك بالحماية القانونية ، بحيث تتمثل هذه المبررات في مبررات قانونية تتمثل في المركز القانوني للمستهلك في علاقته بالمهني ، و مبررات تقنية تمثلت في التطور الحديث في مجال التكنولوجيا المعلومات والاتصالات وحاجة المستهلك الى التنوير المعلوماتي . ولقد اعتمدنا منهج المقارنة والتحليل من خلال وضع مقارنة بين مختلف التشريعات التي تناولت هذا الموضوع وتحليلها . Abstract The idea of providing the consumer with a legal protection it is not a recent idea or restricted to electronic commerce contracts, so whatever the consumer needs a protection if the counter party of the contract is a professional, because the consumer in these contacts is considered a vulnerable party comparison with the professional . so that research is aimed to study the justifications for providing the consumer with the legal protection, therefore these justifications are legal and they are presented in a legal status of the consumer in his relation with the professional ,there are also a technical justifications which presented in the modern development in the field if technology information and communication and consumer ‘s need for the informational enlightenment. We adopted the methodology comparative and analysis through setting a comparison between the different legislation that dealing with this subject and its analysis.
