مدى فعالية أحكام الولاية في تحقيق الامن الاسري داخل المجتمع على ضوء قانون الاسرة الجزائري

Résumé: تعتبر الولاية في عقد الزواج من المواضيع التي كانت ولاتزال محل جدل كبير، وتحت ضغوط بعض الجمعيات النسائية خصوصا، قام المشرع الجزائري بتعديل قانون الأسرة، فتحولت الولاية من ركن في الزواج إلى شرط من شروط الصحة. كما أن المشرع ونتيجة تأثره بالاتفاقيات الدولية التي تقر مبدأ المساواة بين الزوجين، قلص من دور الولي في الزواج. Guardianship in the marriage contract is considered one of the topics that have been and remain highly controversial; and under the pressure of some women's associations in particular, the Algerian legislator amended the Family Code, turning guardianship from a pillar in marriage into a condition of validity. The legislator, influenced by international conventions establishing the principle of equality between spouses, has reduced the role of the guardian in marriage.
