تطبيق مبدأ سير المرفق العام بانتظام واطراد في ظل جائحة كورونا (دراسة تحليلية للحالة الاردنية

Résumé: الملخص تناول هذا البحث موضوعا مستحدثا في ظل انتشار فايروس كورونا (كوفيد19) في الآونة الاخيرة، الا وهو تطبيق مبدأ سير المرفق العام بانتظام واطراد في ظل جائحة كورونا (دراسة تحليلية للحالة الاردنية)، أبرز من خلاله كيفية ضمان تسيير المرافق العامة بانتظام واطراد خلال هذه الجائحة وما هي الضمانات القانونية لهذا المبدأ، اي الحماية القانونية التي يوفرها كل من المشرع والقضاء لهذا المبدأ سواء في الظروف العادية او الظروف الاستثنائية، وتبين عدم نص الدستور الاردني على اي ضمانة لهذا المبدأ سواء في الظروف العادية او الاستثنائية، وكذلك الحال لم تتطرق له التشريعات بشكل صريح خاصة في الظروف الاستثنائية، مما يستدعي النص عليه في صلب الدستور وترجمة ذلك في القوانين والانظمة لما لهذا المبدأ من اهمية بالنسبة للدولة وبالنسبة للأفراد في كل الظروف. Abstract This research dealt with a new topic in light of the spread of Corona virus (Covid 19), which is the principle of the regular and steady functioning of the public facility in light of the Corona pandemic (an analytical study of the Jordanian case), through which we highlighted how to ensure the regular and steady running of public facilities during this pandemic and what are the legal guarantees For this principle, and it has been evident that the Jordanian constitution does not stipulate any guarantee of this principle, whether in normal or exceptional circumstances. Likewise, the legislation has not touching it, especially in exceptional circumstances, which calls for stipulating it in the body of the constitution and translating that into laws because of the importance of this principle for the state and for individuals in all circumstances.
