جنوح الاحداث السيبراني

Résumé: مبدأ "المصالح الفضلى" من المبادئ الجوهرية التي جاءت بها اتفاقية حقوق الطفل لسنة 1989، فهو مبدأ تفسيري وتوجيهي ينبغي الرجوع إليه والاسترشاد به في جميع الإجراءات التي تتعلق بالطفل، الذي كان يعيش ويترعرع ويكتسب الثقافة والهوية والمعايير الاجتماعية ضمن مجتمعه المحلي، لكن حاليا ومع توسع استخدام الانترنت، زال عنصر المكان وتراجع معه سلطان الدولة والمجتمع المحلي في حماية الطفل، وظهرت المجتمعات الافتراضية، فأضحى الطفل اكثر عرضة للانحراف الذي قد يأخذ وصفا جزائيا، لذا فإن تسليط الضوء على جنوح الاحداث في الفضاء السيبراني يشكل فرصة بحثية تحمل في ثناياها انطلاقة نحو حماية المصالح الفضلى للطفل في البيئة الرقمية. "Best interests" is a principle of the 1989 Convention on the Rights of the Child, where it was widely applied in the internal laws as an explanatory and guiding principle, that should be consulted and guided in all actions concerning children, who lived, grew up and acquired culture, identity, and social norms within the local community. Now, with the expansion of the Internet, virtual communities have emerged, borders of countries and locals' community have disappeared, in addition to their authority in protecting the child; Thus, child has become more vulnerable for deviation that may take a punitive description. Therefore, shedding light on juvenile delinquency in the cyberspace constitutes a research opportunity that carries within it a breakthrough towards protecting the best interests of the child in the digital environment.
