علاقة رئيس الجمهورية بالمحكمة الدستورية في ظل التعديل الدستوري الجزائري لسنة 2020.

Résumé: الملخص: تعتبر المحكمة الدستورية مؤسسة مستقلة مكلفة بضمان احترام الدستور فهي تضبط سير المؤسسات ونشاط السلطات العمومية ،في إطار الوظيفة الرقابية حدد المشرع الجزائري تشكيلتها ومنح لرئيس الجمهورية صلاحية تعيين أربعة(4)أعضاء من بينهم رئيس المحكمة الدستورية، كما منحه الدستور صلاحية تحديد شروط وكيفيات انتخاب ستة (6)أعضاء من أساتذة القانون الدستوري. من الناحية الوظيفية تمارس المحكمة الدستورية وظيفتها الرقابية بناء على إخطار من الجهات المخولة بذلك دستوريا و يعتبر رئيس الجمهورية من بين الجهات التي لها صلاحية اخطار المحكمة الدستورية لتمارس مهامها الدستورية . من الصلاحيات الجديدة للمحكمة الدستورية صلاحية اخطارها من قبل رئيس الجمهورية للنظر في الخلافات التي قد تحدث بين السلطات الدستورية، وكذا تفسير حكم أو عدة أحكام دستورية. The counstitutional court is an independent institution charged with ensuring respect for the constitution ,it controls the functioning of institutions and the activity of public authoritis within the framework of the oversight function ,the algerian legislator determined its composition and granted the president of the republic granted the power to oppoint four(4) members, including the president of constitutional court,the constitution also granted him the power to determined the conditions and modalities for electing six(6) members of constitutional law prpfessors . In terms of the functionaly The counstitutional court exercises its oversight function based on a notification from constitutionlly authorized bodies,and the president of the republic is considered among the bodies that have the power to notify the constitutional court to exercise its constitutional functions. Among the new powers of the constitutional court is the power to consider disputes that may occur between the constitutional authorities,as well as the interpretation of one or several constitutional provisions based on notification the president of the republic
