رقابة المحكمة الدستورية لصلاحيات رئيس الجمهورية في ظل التعديل الدستوري لسنة 2020 the Constitutional Court Control Of The President’s Powers Under The Constitutional Amendment Of 2020

Résumé: بموجب التعديل الدستوري لسنة 2020 ، سجل المؤسس الدستوري نقطة انعطاف في مسار نظام الرقابة الدستورية في الجزائر من خلال استبدال المجلس الدستوري ذي الطابع السياسي بالمحكمة الدستورية التي تميزت بتغليب الطابع الأكاديمي على تشكيلتها بالموازاة مع التكريس الصريح لدورها في ضبط سير المؤسسات الدستورية . يبرز هذا المقال اتساع الهوة بين حجم الدور المناط بالمحكمة الدستورية والوسائل القانونية المتاحة لها لتجسيد هدفها في ضمان احترام الدستور خصوصا إزاء ما يتمتع به رئيس الجمهورية من صلاحيات واسعة في إنشاء القاعدة القانونية من جهة و سلطات دستورية تجعله محور الدوران في النظام السياسي الجزائري من جهة أخرى. Under the constitutional Amendment of 2020, the constitutional control system in Algeria marked a turning point in its evolution process, the constitutional founder decided to replace the constitutional Council which its political nature, by a constitutional Court, characterized by the academic nature of its components , while explicitly reinforcing the court’s role in the regulation of constitutional institutions functioning . This article highlights the widening gap between the scope of the mission assigned to the constitutional court , and the legal means at its disposal to achieve its goal of ensuring the respect of the constitution , especially in the light of the broad powers attributed to the president of the republic with regard to the establishment of the law rule in one hand , and the sweeping constitutional powers bestowed upon him , making the president of the republic the focal point in Algeria’s political system on the other hand.
