عوارض الأهلية والحلول القانونية المقررة لها في التشريع الجزائري - دراسة مقارنة – Incidents Of The Capacity And Solutions Envisaged By The Algerian Legislation - Comparative Study-

Résumé: الملخص: يقصد بالأهلية صلاحية الشخص لاكتساب الحقوق والتحمل بالالتزامات (أهلية الوجوب) وقدرته على مباشرتها(أهلية الأداء)، وما يمكن ملاحظته هو أن أحكام الأهلية متناثرة مابين القانون المدني وقانون الأسرة مما خلق تباعدا وازدواجية في الأحكام بشأن غير كاملي الأهلية الذين يخضعون لأحكام الولاية أو الوصاية أو القوامة، وسبب الازدواجية في الحكم هو اختلاف مصدر القانونين. ولم يميز المشرع الجزائري بين حالتي الجنون كما هو وارد في التشريعات المقارنة وكذا الشريعة الإسلامية. وتأسيسا على ما سبق يتعين توحيد الأحكام المتعلقة بالأهلية والنيابة الشرعية في قانون واحد لتجنب التكرار وعدم الإنسجام في القواعد القانونية. Abstract: The legal capacity it is the aptitude of a person for to be holder of rights and obligations (capacity of enjoyment) and to exert them(capacity of exercise), It is noted that the dispositions of the capacity are scattered the ones in the civil code and the others in the code of the family what generates a divergence as well as a duality as for the dispositions as for the incapables persons who are subjected to the mode of the supervision or the testamentary supervision or trusteeship. This distinction of the source causes the duality of the dispositions. Noting that Algerian legislator didn’t distinguish between the two types of insanities such as the depositions of the law compared as well as the charia. Thus it is necessary to unify the dispositions relating to the capacity and the legal representation in only one law in order to avoid the redundancy and the discordance of the legal rules.
