الحماية القانونية للانتخابات في ظل السلطة الوطنية المستقلة المستحدثة بالقانون العضوي رقم 19_07

Résumé: ملخص: تعتبر السلطة الوطنية المستقلة للانتخابات هي الجهة الوحيدة المخولة قانونا في الإشراف والتسيير والمراقبة وإعلان نتائج الانتخابات وتعمل على حيادية الانتخابات والوقوف على مسافة واحدة بالنسبة لجميع المترشحين سواءا تقدموا أحرارا أو عن طريق الأحزاب وذلك من خلال دورها الفعال في سير الانتخابات وما تكتسبه من ضوابط لضمان الحماية القانونية للانتخابات في تجسيد وتعميق الديمقراطية الدستورية وترقية النظام الانتخابي المؤدي الى التداول السلمي والديمقراطي لممارسة السلطة لتحكم مبدأ سيادة الشعب عن طريق انتخابات حرة ونزيهة وشفافة تعبر عن ارادة الشعب الحقيقية ، ويكون ذلك بألية قانونية متمثلة في القانون العضوي 07/19 الذي حدد مجال سير وتدخل السلطة من حيث استقلالها وتشكيلتها لحماية هذه الانتخابات ذلك ابتداء من يوم الاعلان عن موعد الاستحقاقات الانتخابية وإستدعاء الهيئة الانتخابية من طرف رئيس الجمهورية و البدء في تسجيل الناخبين في القوائم الانتخابية ومراجعتها مرورا بكل مراحل تحضير العملية الانتخابية و التصويت لتصل لإعلان النتائج وذلك وفق القانون العضوي رقم 08/19 المتضمن قانون الإنتخابات . The Independent National Authority for Elections is the only body legally authorized to supervise, manage, monitor and announce election results, and it works on the neutrality of elections and standing at a distance for all candidates, whether they advance freely or through parties, through its effective role in the conduct of the elections and the controls it acquires to ensure legal protection Elections are in the embodiment and deepening of constitutional democracy and the promotion of the electoral system leading to the peaceful and democratic circulation of the exercise of power to govern the principle of the sovereignty of the people through free, fair and transparent elections that express the true will of the people. As it is independent and formed to protect these elections, starting from the day of announcing the date of the electoral entitlements, the election of the electoral college by the President of the Republic, and the start of registering voters in the electoral lists and reviewing them, through all the processes of preparing the electoral process and voting operations to reach the announcement of the results, according to Organic Law No 08/19 Including the election law..
