اللجنة البلدية للصفقات كأداة للرقابة الخارجية على الصفقات العمومية في ظل المرسوم الرئاسي 15-247

Résumé: في إطار الرقابة الإدارية على الصفقات العمومية، أنشأ المشرع الجزائري بموجب المرسوم الرئاسي 15-247 الصادر في 16 سبتمبر سنة 2015 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام لجانا خاصة بالرقابة، منها اللجنة البلدية للرقابة على الصفقات العمومية، تتميز هذه اللجنة بنظام قانوني خاص، سواء من حيث التشكيلة أو من حيث المهام، وتمثل اللجنة البلدية مركز اتخاذ القرار فيما يخص منح التأشيرة التي هي أحد أدوات حماية المال العام. من هذا المنطلق ستتناول دراسة تشكيلة هذه اللجنة، اختصاصها وقواعد سير عملها لتبيان مدى فعاليتها في جدية الرقابة ومدى قدرتها على حماية المال العام. Within the framework of administrative oversight of public deals, the Algerian legislator established by presidential decree 15-247 issued on September 16, 2015, which includes the regulation of public deals and the mandates of the general facility for oversight committees, including the municipal committee to oversee public deals, this committee is distinguished by a special legal system, whether in terms of formation or in tasks, the municipal committee represents the decision-making center regarding granting the visa, which is one of the tools for protecting public money. From this standpoint, we study the composition of this committee, its competence and the rules of its work flow, and we show its effectiveness in the seriousness of monitoring and its ability to protect public money.
