Résumé: ملخص: بهدف الحفاظ على الرونق الجمالي للمدن وكفالة العيش الكريم للمواطن وحماية البيئة سعى المشرع الجزائري إلى تبني نظام المساحات الخضراء منذ عام 2007، حيث صدر القانون رقم 07-06 المتعلق بالمساحات الخضراء، كما صدرت عدة مراسيم تنفيذية وقرارات وزارية في إطار هذا القانون تهدف كلها إلى بيان كيفية تسيير المساحات الخضراء وحمايتها وتنميتها، حيث تخل المشرع الجزائري وأكد على أن العقوبات المتعلقة بالمساحات الخضراء كلها عقوبات سالبة للحرية.
